These terms apply when you use Find Equipment Sales. By using the site you agree to them. If you do not agree, please do not use the site.
1. What this site is
Find Equipment Sales is a search platform. We index equipment advertised for sale by Australian dealers on their own websites, present it in one searchable place, and link you back to the seller. We separately arrange equipment finance for people who ask us to.
We are not the seller. We do not own, hold, inspect, warrant or sell any of the equipment listed here. We are not the agent of any dealer and we are not acting on their behalf. We take no commission on any sale. Every transaction is between you and the seller, on the seller's terms.
2. Listing information
Prices, specifications, photographs, availability and every other detail shown for a listing are as published by the selling dealer at the time we last checked, which is shown on each listing page. Stock in this market moves quickly and dealers do not always update or remove advertisements promptly.
We therefore do not warrant that any listing is current, complete or accurate. Confirm everything directly with the dealer before you commit — including the price, whether GST is included, hours or kilometres, condition, compliance and what is actually included in the sale.
Where we show a comparison against other listings, or an estimated value, that figure is derived from advertised asking prices in our own index. It is a market observation, not a valuation, not a recommendation, and not advice about what you should pay or accept. Our methodology page explains exactly how those figures are produced and what their limits are.
3. Finance
Repayment figures shown on this site are indicative estimates generated by a calculator. They are not offers of credit, not pre-approvals, and not a quote. They assume a fixed-rate amortising facility calculated on the advertised price and do not account for fees, charges, on-road costs, insurance, GST treatment or anything about your circumstances.
Any finance we arrange is subject to lender criteria, credit assessment, and terms and conditions. Eligibility criteria and fees apply. Nothing on this site is personal credit advice, financial advice or tax advice, and it does not take account of your objectives, financial situation or needs. Get your own advice before entering a finance contract.
4. Dealer names and trade marks
We refer to dealers by name so you know who is selling what, and we link to their listings. That is identification, not endorsement. We are not affiliated with, sponsored by or endorsed by any dealer, manufacturer or marketplace named on this site, and all trade marks remain the property of their owners.
Photographs shown alongside listings are served from the dealer's own website and remain the property of the dealer or the photographer. If you are a rights holder and you want something removed, see section 8.
5. Our content
The design, code, structure, written content, category taxonomy, generated descriptions and analysis on this site are ours. You may not copy, republish or commercially exploit them without our written permission.
6. Acceptable use
You must not:
- use automated tools to scrape, harvest, mirror, frame or bulk-copy this site or the data on it;
- compile a database or index from our content;
- interfere with the operation of the site, or attempt to access parts of it you are not authorised to access;
- use the site to send unsolicited commercial messages, or to collect contact details for that purpose;
- misrepresent yourself, or submit an enquiry using someone else's details; or
- use the site for any unlawful purpose.
If you want access to our data for a legitimate purpose, ask us — contact@findequipment.com.au. We would rather talk about it than block you.
7. Links to other sites
This site links to dealer websites and other third-party sites. We do not control them and we are not responsible for their content, their terms, their privacy practices or anything you do there.
8. Removal requests
If you are a dealer, a photographer or any other rights holder and you want a listing, an image or an entire domain removed from this site, email takedown@findequipment.com.au. We action removal requests within 48 hours, permanently, and we do not ask you to justify the request. Full detail is on our takedown page.
9. Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where we are permitted to limit our liability, we do so.
Subject to that, and to the extent the law allows, we are not liable for loss arising from: a listing being inaccurate, out of date or no longer available; any dealing you have with a dealer or lender; any decision you make in reliance on an estimated value or price comparison; or the site being unavailable.
10. Privacy
Our privacy policy explains how we handle personal information, including who we disclose finance enquiries to.
11. Changes
We may change these terms. The current version is always on this page with the date at the top, and it applies from the moment it is published.
12. Governing law
These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
13. Who operates this site
This site is operated by Find Equipment Sales. Finance enquiries submitted through this site are referred to our finance partner, who is identified on the finance page and in the repayment disclaimer at the foot of every page.
14. Contact
Draft for review. Prepared as a starting point, not reviewed by a lawyer. The liability and finance sections in particular need proper legal review — Australian Consumer Law consumer guarantees cannot be contracted out of, and a term that claims otherwise can itself be a problem.
